Tenant Fees

About the Tenant Fees Act 2019

The Tenant Fees Act 2019 caps and bans certain letting fees and tenancy deposits paid by tenants in England. This applies to new or renewed tenancy agreements signed on or after 1 June 2019. The Act ensures that tenants only pay permitted fees and are protected from unfair charges.

Permitted Payments

Rent
The agreed monthly amount as set out in your tenancy agreement. This is payable in advance on the date specified.
Tenancy Deposit
Capped at 5 weeks' rent where annual rent is under £50,000, or 6 weeks' rent where annual rent is £50,000 or above. Your deposit will be protected in a government-approved scheme.
Holding Deposit
Capped at 1 week's rent. This reserves the property while references and checks are carried out. It will be put towards your first month's rent or returned if the tenancy does not proceed through no fault of your own.
Utilities, Council Tax & Other Charges
You are responsible for utilities (gas, electricity, water), council tax, TV licence, telephone, and broadband unless otherwise stated in your tenancy agreement.
Late Payment of Rent
Interest may be charged at 3% above the Bank of England base rate where rent is more than 14 days overdue. This charge will only be applied on the amount outstanding.
Lost Keys or Security Devices
If you lose keys or security devices, you will be charged the reasonable cost of replacement and any associated costs such as changing locks if required for security.
Variation of Tenancy
If you request a change to your tenancy agreement (such as adding a tenant or changing the tenancy term), a fee of £50 or reasonable costs incurred, whichever is greater, may apply.
